This Court granted the Petitioners leave to proceed on 12th November 2007 on an alleged infringement of Article 12(1) of the Constitution of the Democratic Socialist Republic of Sri Lanka.
Petitioners presented their case on the basis of an infringement pertaining to the acquisition of land on the premise that such land would be utilized to serve a public purpose whereas, by this impugned executive or administrative action the land was knowingly, deliberately and manipulatively sold to a private entrepreneur to serve as an exclusive and private golf resort in Sri Lanka, one carrying a membership fee of Rs. 250,000/=. Learned Counsel submitted that this was done through a process that was conniving and contrary" to the equal protection of the law guaranteed by Article 12(1) of the Constitution which assures to the People the Rule of Law. Counsel also submitted that the facts in this case reflected a flagrant betrayal of the purported policy of the 1994 government under the 1st Respondent to establish transparent governance and eliminate corruption, and that the facts disclose that this transaction reeked of corruption.

Lanka Marine Service Limited Sold 90 percent of shares in the Government owned illegally
Lanka Marine Service Limited Sold 90 percent of shares in the Government owned illegally - Supreme Court against illegal share sales agreement. The Supreme Court yesterday allowing the rights application against the sale of 90 percent of shares in the Government-owned Lanka Marine Service Limited (LMSL) to John Keells Holdings Limited (JKH) held that the rights of the petitioner and the public had been violated by the share transfer.
The Bench comprised Chief Justice Sarath N Silva PC with Justice Nimal Gamini Amaratunga and Justice Jagath Balapatabendi. Chief Justice Sarath N Silva PC delivering a 70 pages long judgment with other judges agreeing held that the transfer of the eight acre land with the fuel storage facility located at Bloemendhal Road, belonging to the Sri Lanka Ports Authority to the LMSL was illegal and void. The Chief Justice ordered that LMSL to revert the land to the SLPA.
The Court ordered former PERC Chairman and Secretary to the Treasury P.B. Jayasundara to pay Rs. 500,000 as compensation to the State. JKH Chairman Susantha Rathnayake was also ordered to pay Rs. 250,000 as costs to the petitioner, Secretary of the Democratic Left Front Vasudeva Nanayakkara.
